A Texas woman who allegedly suffered falls while under a nursing home’s care lost her bid to compel the facility to disclose general policies and procedures before she submits an expert report required by the state’s medical malpractice law, the state’s supreme court said Friday.

Donna Smith was a patient at Signature Pointe Senior Living Community, a nursing home owned by LCS SP LLC for about three months in 2019. Smith’s husband, Kenneth Smith, removed her from the facility after she fell multiple times while in LCS’s care, fracturing her ankle, shoulder, and hip.
